These Terms of Sale apply to orders placed through the California Hash website.

By submitting an order, you agree to these Terms of Sale, our Terms of Use, Privacy Policy, and any policies displayed by the licensed retailer fulfilling your order.

1. LICENSED SELLER

Each cannabis order is sold and fulfilled by the participating licensed retailer identified during checkout and in your order confirmation.

California Hash may provide the website, menu, location, and ordering technology used to connect you with that retailer.

The fulfilling retailer is responsible for accepting the order, verifying eligibility, preparing the products, and completing pickup or delivery.

2. CUSTOMER ELIGIBILITY

You must be legally eligible to purchase cannabis in the jurisdiction where the order is fulfilled.

Adult-use customers must generally be at least 21 years old.

Medical cannabis customers and caregivers must provide any documentation required by applicable law.

A valid government-issued photo ID may be required during checkout, pickup, or delivery.

An order may be refused or cancelled if your age, identity, medical status, or purchasing eligibility cannot be verified.

3. LOCATION REQUIREMENTS

You must select the correct state, store, and fulfillment location before submitting an order.

Cannabis products may be purchased only from a retailer licensed to operate within the applicable state.

Delivery is available only within legally authorized service areas.

Cannabis products will not be shipped or delivered across state or international borders.

You may not provide a false address, use a forwarding service, or arrange for unlawful transportation.

4. PRODUCT AVAILABILITY

Products displayed on the website are subject to availability.

Adding a product to your cart does not reserve it.

A product may become unavailable before the retailer accepts or prepares your order.

The retailer may substitute a product only with your approval.

If a product is unavailable and no substitution is approved, the item may be removed and any applicable payment may be refunded or adjusted.

5. PRODUCT INFORMATION

We make reasonable efforts to display accurate product descriptions, photographs, prices, ingredients, potency, and availability.

Product information may be provided by retailers, manufacturers, distributors, or laboratories.

Packaging, appearance, cannabinoid content, and batch information may vary.

You should review the physical product label before use.

The physical label and verified retailer records will control if they differ from information displayed online.

6. PRICES, TAXES, AND FEES

Prices may vary by store and location.

Applicable taxes, delivery fees, service fees, discounts, and other charges will be displayed before you submit the order.

Prices may be corrected if they were displayed incorrectly because of a technical, inventory, or data-entry error.

The retailer may cancel an order containing a material pricing error.

7. PURCHASE LIMITS

All orders are subject to applicable state and local purchase and possession limits.

The retailer may reduce or cancel an order that exceeds a legal limit.

Limits may apply across multiple products or transactions completed within the same period.

You may not create multiple accounts or place separate orders to avoid purchase restrictions.

8. ORDER SUBMISSION AND ACCEPTANCE

Submitting an order is a request to purchase products from the selected licensed retailer.

An automated email or message confirming receipt does not necessarily mean that the order has been accepted.

The order is accepted only when the retailer confirms that it will prepare or fulfill it.

The retailer may refuse or cancel an order because of product availability, legal restrictions, identification issues, payment problems, suspected fraud, safety concerns, or operational limitations.

9. PAYMENT

Available payment methods may vary by retailer and jurisdiction.

You represent that you are authorized to use the selected payment method.

Some payment methods may require payment at pickup or delivery.

You are responsible for all approved charges associated with your order.

Payment authorizations, temporary holds, and processing times may be controlled by third-party payment providers.

10. PICKUP ORDERS

Pickup orders must be collected from the retailer identified in the order confirmation.

You must arrive during the stated pickup period and provide any required identification or medical documentation.

The name on the identification may be required to match the order.

Another person may not collect your order unless permitted by law and approved by the retailer.

Uncollected orders may be cancelled after the retailer’s stated holding period.

11. LOCAL DELIVERY

Delivery is available only from participating retailers and within authorized service areas.

The customer receiving the order must be present at the approved delivery address.

Valid identification and any required medical documents must be presented before the products are transferred.

Cannabis orders will not be left unattended, placed in mailboxes, or delivered to unauthorized persons.

The retailer or delivery provider may refuse delivery if the address, customer identity, eligibility, or safety requirements cannot be verified.

Additional delivery attempts or fees may apply where permitted and disclosed.

12. ORDER CHANGES AND CANCELLATIONS

You may request an order change or cancellation before the retailer begins preparing or dispatching the order.

A request is not guaranteed to be approved.

The retailer may refuse changes that would affect legal purchase limits, inventory, taxes, delivery records, or regulatory reporting.

Once an order has been completed, cancellation may no longer be available.

13. RETURNS AND REFUNDS

Cannabis products may be subject to restrictions on returns because of health, safety, inventory-control, and regulatory requirements.

Returns or refunds may be considered for incorrect products, damaged packaging, defective products, recalled products, or other issues recognized by the fulfilling retailer.

You should contact the retailer identified in your order confirmation as soon as possible after discovering a problem.

You may be asked to provide your receipt, order number, photographs, product packaging, or batch information.

Products should not be returned to a store or delivery driver without prior authorization.

Approved refunds will generally be issued using the original payment method where possible.

14. PROMOTIONS AND DISCOUNTS

Promotions may be limited to participating stores, products, dates, customers, or jurisdictions.

Promotions have no cash value unless expressly stated.

Discounts may not be combined unless permitted by the retailer.

A promotion may be changed or withdrawn where permitted by law.

The retailer may reject the misuse of promotional codes, referral offers, loyalty rewards, or pricing errors.

15. PRODUCT SAFETY AND RECALLS

Follow all instructions, warnings, serving information, and storage directions printed on the product packaging.

Keep cannabis products away from children and animals.

Do not use a product that appears damaged, contaminated, improperly sealed, or subject to a recall.

California Hash or the fulfilling retailer may contact you regarding a safety issue, correction, or product recall.

You should follow all stop-use, return, or disposal instructions provided in a recall notice.

16. RESPONSIBLE USE

Do not drive, operate machinery, or perform hazardous activities while impaired.

Do not provide cannabis to minors or other ineligible persons.

Do not consume cannabis where prohibited.

You are responsible for the lawful possession, storage, transportation, and use of products after they have been transferred to you.

17. RESALE PROHIBITED

Products purchased through the website are intended for lawful personal use.

You may not resell, redistribute, export, or commercially transfer cannabis products unless you hold all required licences and authorizations.

18. LIMITATION OF LIABILITY

To the maximum extent permitted by law, California Hash will not be liable for indirect, incidental, special, punitive, or consequential damages arising from an order or transaction.

Nothing in these Terms excludes liability that cannot legally be excluded or limits any non-waivable consumer right.

The fulfilling retailer may be separately responsible for matters relating to its products, employees, premises, pickup services, or delivery operations.

19. GOVERNING LAW

Each cannabis transaction is governed by the laws of the state and local jurisdiction in which the fulfilling retailer operates.

These Terms do not remove any consumer rights that cannot legally be waived.

20. CHANGES TO THESE TERMS

California Hash may update these Terms to reflect changes in law, regulation, technology, business operations, or retailer requirements.

The updated version will be posted with a revised “Last Updated” date.

The version in effect when your order is accepted will generally govern that transaction.
